WHEREAS, CMS policy on the medical use of marijuana was formulated in response to a ballot initiative in 2000, and

 

WHEREAS, Amendment 20 was approved by the voters and became law June 2001 allowing patients, with documentation from their physicians, to legally use marijuana for certain medical conditions, and

 

WHEREAS, current Colorado state law allowing the medical use of marijuana is in conflict with current CMS policy and therefore produces an ethical conflict as well as potential legal risk for those physicians who would recommend the medical use of marijuana for selected patients, therefore be it

 

RESOLVED, that the current CMS policy on the medical use of marijuana be sunset.
