WHEREAS, the House of Delegates has adopted a resolution to establish a Bona Fide Health Association Plan, and
WHEREAS, this Bona Fide Health Association Plan will allow CMS to offer health insurance to its members and their families, and
WHEREAS, coverage should also be offered to the physician's office staff and their families, and
WHEREAS, to meet the Division of Insurance requirements, a classification of membership to include the practice entity must be established, therefore be it
RESOLVED, that the Colorado Medical Society amend the Bylaws as follows, and be it further
RESOLVED, that the cost of the practice entity membership will be determined by the Board of Directors, and be it further
RESOLVED, that in order to qualify as a practice entity, 100% of the physicians in the practice participating in the health plan must be CMS members.
Chapter I Ð Membership, Section 3. Classes of Members
e. Non-Physician Members:
(1) Non-Physician Members. Non-Physician Members of the Colorado Medical Society are non-physicians who have been elected by component societies to any form of component society membership other than active and honorary membership, who are in good standing in such membership, who have been so certified to the CMS headquarters, and who meet one of the following qualifications:
(A) Dentists who hold a degree of DMD or DDS who are members of the American Dental Association and of the state and local dental societies;
(B) Teachers of medicine or of the sciences allied to medicine, who are citizens of the United States and are ineligible for Active Membership;
(C) Individuals engaged in endeavors related to medicine who have attained distinction in their fields of endeavor as determined by the component society and/or the Board of Directors of the Colorado Medical Society.
(D Active Members Practice Entity
A practice entity that is owned and controlled by an active member or active members shall be accorded this membership classification. The term "practice entity" shall include professional corporations, limited liability partnerships, limited liability companies and sole practitioners operating as a sole proprietor.
(2) Non-Physician Members shall pay Colorado Medical Society annual dues or assessments in an amount to be established by the Board of Directors. Non
Physician Members may neither vote nor hold office in the Colorado Medical Society, but shall have other rights and privileges of the Society.
